Things are getting white hot here in New York State!
Thanks to the support of so many members of the NYS Firearms Association, we were able to file a lawsuit challenging Kathy Hochul’s ammo registration scheme the day it took effect!
The case was filed in Federal District Court (Western District) and was just assigned to Judge Frank Geraci in Rochester.

Of course, the primary argument made in our federal lawsuit is that Hochul’s new ammo registration law is blatantly unconstitutional.
Hochul’s new law requires the State Police to record the name, address, and occupation of everyone who buys ammo — along with the caliber and amount of ammo you buy!
This is insanity.
And it won’t stand in court.
Don’t forget that last year’s Bruen decision stated that all gun control laws must show that they have a ‘historical precedent’ to be considered constitutional.
There is no legal precedent for this. Hochul knows that. She simply doesn’t care. This new law is simply her waving a middle finger to the United States Supreme Court and the Constitution.
So we’ve returned the gesture to Hochul, by filing this lawsuit in Federal Court.
But while our original lawsuit was based squarely on constitutional grounds, it’s become clear that there is a more urgent, practical issue that we need to address — Hochul’s ammo registration database simply doesn’t work!
The reports began coming into our office immediately.
A gun owner in Corning was told he couldn’t buy ammo at a ‘mom and pop’ retailer because the database was down.
A retailer in Ontario County told us that while his system wasn’t technically ‘down,’ it was delayed by hours, forcing customers to walk away in frustration.
Another gun owner, this one from Erie County, told our lawyers that multiple gun stores around Buffalo were unable to sell ammo due to ‘system delays.’
So I went to check things out for myself.
First, I went to the Wal-Mart in Canandaigua and tried to buy ammunition. The employee there told me that the system had been offline for a day and a half and there was ‘nothing he could do’ since there was no backup system.
Then I went to the Runnings just a few blocks away.
While I was there, I saw this handwritten sign taped to the gun counter informing me that the system was down and that all gun and ammo sales were suspended!
When I spoke to the clerk running the gun counter, he told me that their computer wouldn’t sign into the State Police database so they had to stop all sales!
Worse, he told me that I was the 20th customer that he turned away that day — and it was only 12:30pm in the afternoon!
So while criminals can ignore this law and acquire ammo through a variety of means, law abiding New Yorkers are unable to buy ammo because the State Police database does not work.
That’s why we are working to file an emergency Temporary Restraining Order (TRO) with the court, asking them to block the enforcement of this law pending the outcome of our lawsuit!

I understand the frustration of many gun owners out there when it comes to the courts…they seldom get it right.
But the Bruen decision undid over 100 years of tyrannical gun control laws at one time, so they get it right sometimes!
Another complaint I hear is that even when the courts get it right, it takes a long time for that to happen. And that’s true to a certain degree.
That’s exactly why we plan to file the TRO, to seek an expedited hearing on our lawsuit while asking the judge to injunct the state from enforcing the ammo registration law in the meantime!
Sure, nothing is certain in the federal court system.
But if there was ever a time for the courts to grant a TRO, it’s when the Second Amendment rights of 20 million New Yorkers are on pause because Kathy Hochul’s database doesn’t work!
(If we don’t take Hochul to court, law abiding gun owners will be disarmed thanks to signs like this!)
Our legal team is preparing for this now, but I need to know that I can cover their bill before we can commit to this course of action.
And that’s why I’m contacting you.
